The return of funds to the creditor in the amount of more than 10 million rubles by initiating bankruptcy proceedings against the debtor-citizen, challenging transactions made by the debtor before the bankruptcy and the sale of property belonging to the debtor.

IMPLEMENTED MEASURES:

 
Actions aimed at preventing the inclusion of fictitious debts of third parties in the register of creditors' claims of the debtor were carried out, in particular, reasonable objections to the claims of third parties were prepared on the basis of Articles 10 and 170 of the Civil Code of the Russian Federation and effective representation of the creditor's interests was carried out in court sessions on separate disputes on the inclusion of third parties in the register of creditors' claims of the debtor;
 
Productive interaction with the debtor's financial manager was built, as a result of which the entire set of transactions made by the debtor/debtor's spouse on the eve of bankruptcy in order to withdraw assets from the creditor's foreclosure was revealed;
 
A full legal analysis of transactions made by the debtor/debtor's spouse before the bankruptcy in order to withdraw assets from the creditor's foreclosure was carried out, all necessary evidence was collected, substantiated statements on challenging transactions were prepared on the basis of Articles 10 and 168 of the Civil Code of the Russian Federation and the creditor's interests were represented in court sessions of the courts of first instance, appeal and cassation instances separate disputes on contesting the debtor's transactions;
 
Negotiations with the debtor on a peaceful settlement of the dispute have been conducted, a legal mechanism has been structured and all necessary documents have been prepared for a peaceful settlement of the dispute with the debtor.

RESULTS:

Effective legal protection of the creditor's rights in the framework of an insolvency (bankruptcy) case of a citizen, carried out by preventing fictitious claims of third parties from being included in the register of creditors' claims of the debtor, challenging transactions made by the debtor/debtor's spouse in respect of property owned jointly by the spouses, and aimed at withdrawing the debtor's assets from the creditor's foreclosure, in fact led to the acquisition of a substantial monetary claim against the debtor's daughter, in whose favor assets were alienated on the eve of bankruptcy, this forced the debtor to enter into negotiations with the creditor on a peaceful settlement of the dispute, as a result of which the creditor's claims in the amount of more than 10 million rubles were fully satisfied.
